Just past the Oval Office, in the private dining room overlooking the South Lawn, Vice President Cheney joined President Bush at a round parquet table they shared once a week. Cheney brought a four-page text, written in strict secrecy by his lawyer. He carried it back out with him after lunch.The Constitution is pretty clear on what the role of the vice president is: A) have a pulse, and B) break a tie in the Senate. One can only imagine what the right wing's reaction would have been had Al Gore asserted that he was a fourth branch of government.
In less than an hour, the document traversed a West Wing circuit that gave its words the power of command. It changed hands four times, according to witnesses, with emphatic instructions to bypass staff review. When it returned to the Oval Office, in a blue portfolio embossed with the presidential seal, Bush pulled a felt-tip pen from his pocket and signed without sitting down. Almost no one else had seen the text.
Cheney's proposal had become a military order from the commander in chief. Foreign terrorism suspects held by the United States were stripped of access to any court -- civilian or military, domestic or foreign. They could be confined indefinitely without charges and would be tried, if at all, in closed "military commissions."
"What the hell just happened?" Secretary of State Colin L. Powell demanded, a witness said, when CNN announced the order that evening, Nov. 13, 2001. National security adviser Condoleezza Rice, incensed, sent an aide to find out. Even witnesses to the Oval Office signing said they did not know the vice president had played any part.
The episode was a defining moment in Cheney's tenure as the 46th vice president of the United States, a post the Constitution left all but devoid of formal authority. "Angler," as the Secret Service code-named him, has approached the levers of power obliquely, skirting orderly lines of debate he once enforced as chief of staff to President Gerald R. Ford. He has battled a bureaucracy he saw as hostile, using intimate knowledge of its terrain. He has empowered aides to fight above their rank, taking on roles reserved in other times for a White House counsel or national security adviser. And he has found a ready patron in George W. Bush for edge-of-the-envelope views on executive supremacy that previous presidents did not assert.

Everyone knows this administration has disdained openness and accountability since its first days. That is about the only thing it does not hide. But recent weeks have produced disturbing disclosures about just how far Mr. Bush’s team is willing to go to keep lawmakers and the public in the dark.
That applies to big issues — like the C.I.A.’s secret prisons — and to things that would seem too small-bore to order up a cover-up.
Vice President Dick Cheney sets the gold standard, placing himself not just above Congress and the courts but above Mr. Bush himself. For the last four years, he has been defying a presidential order requiring executive branch agencies to account for the classified information they handle. When the agency that enforces this rule tried to do its job, Mr. Cheney proposed abolishing the agency.
Mr. Cheney, who has been at the heart of the administration’s darkest episodes, has bizarre reasons for doing that. The Times reported that the vice president does not consider himself a mere member of the executive branch. No, he decided the vice president is also a lawmaker — because he is titular president of the Senate — and does not have to answer to the executive branch. That is absurd, but if that’s how he wants it, we presume Mr. Cheney will stop claiming executive privilege to withhold information from his fellow congressmen.
Since the 9/11 attacks, Mr. Bush has tried to excuse his administration’s obsession with secrecy by saying that dangerous times require greater discretion. He rammed the Patriot Act through Congress with a promise that national security agencies would make sure the new powers were not abused.
But on June 14, The Washington Post reported that the Federal Bureau of Investigation potentially broke the law or its own rules several thousand times over the past five years when it used the Patriot Act to snoop on domestic phone calls, e-mail and financial transactions of ordinary Americans.
We knew that Attorney General Alberto Gonzales was not protecting anybody’s rights or America’s reputation. It turns out that John Rizzo, the man charged with safeguarding the Constitution at the Central Intelligence Agency, isn’t either. After serving as the C.I.A.’s deputy general counsel or acting general counsel for the entire Bush administration, he was nominated as general counsel more than a year ago. But the Republican chairman of the Senate Intelligence Committee, Pat Roberts of Kansas, would not schedule even a pro forma confirmation hearing because the Democrats wanted documents that the C.I.A. wanted to keep, well, secret.
Last week, the committee held that hearing under Democratic leadership, and Mr. Rizzo kept insisting that he shouldn’t, couldn’t, wouldn’t give away any secrets. But he was still illuminating — in a scary way.
When he was asked his view of the administration’s infamous decision to define torture so narrowly that it allowed widespread abuse of prisoners, he merely said the policy was “overbroad” for the circumstances, raising the troubling question of when he thinks it would not be overbroad to torture prisoners. Mr. Rizzo also refused to say whether the United States had ever sent a prisoner to another country knowing he would be tortured. He made it sound like he was safeguarding secrets, but we suspect the real reason was that the answer is “yes.”
Meanwhile, Mr. Rizzo, Mr. Bush, Mr. Cheney and the rest of the administration are still stonewalling about the existence of C.I.A. prisons. Earlier this month, the Council of Europe, a 46-nation human rights group, provided new, persuasive evidence of secret American prisons in Eastern Europe where prisoners were kept naked in cramped cells, subjected to hot or freezing blasts of air and subjected to water-boarding, or simulated drowning. American rights groups released a list of 39 men they say disappeared into secret prisons.
Incredibly, the lies and secrecy shrouding this administration are not enough for Mr. Rizzo. Sounding an awful lot like Mr. Bush and Mr. Cheney, he told the senators, “Far too many people know far too much.”
Governments have to keep secrets. But this administration has grossly abused that trust, routinely using claims of national security to hide policies that are immoral and almost certainly illegal, to avoid embarrassment, and to pursue Mr. Bush’s dreams of an imperial presidency.
As a presence in the world—a body hanging from a subway strap or pressed into an elevator, a figure crossing the street—I am neither markedly masculine nor notably effeminate. Nor am I typically perceived as androgynous, not in my uniform of Diesels and boots, not even when I was younger and favored dangling earrings and bright Jack Purcells. But most people immediately read me (correctly) as gay. It takes only a glance to make my truth obvious. I know this from strangers who find gay people offensive enough to elicit a remark—catcalls from cab windows, to use a recent example—as well as from countless casual social engagements in which people easily assume my orientation, no sensitive gaydar necessary. I’m not so much out-of-the-closet as “self-evident,” to use Quentin Crisp’s phrase, although being of a younger generation, I can’t subscribe to his belief that it is a kind of disfigurement requiring lavender hair rinse.- Opus: God spaketh.
I once placed a personal ad in which I described myself as “gay-acting/gay-appearing,” partly as a jab at my peers who prefer to be thought of as “str8” but mostly because it’s just who I am. Maybe a better way to phrase it would have been “third-sexer,” the category advanced by the gay German sexologist Magnus Hirschfeld 100 years ago. The label fell into disrepute, but lately a number of well-known researchers in the field of sexual orientation have been reviving it based on an extensive new body of research showing that most of us, whether top or bottom, butch or femme, or somewhere in between, share a kind of physical otherness that locates us in our own quadrant of the gender matrix, more like one another than not. Whatever that otherness is seems to come from somewhere deep within us. It mostly defies our efforts to disguise it. That’s what we mean by gaydar—not the skill of the viewer so much as the telltale signs most gay people project, the set of traits that make us unmistakably one.
The late psychologist and sexologist John Money famously called these the details of our “gendermaps,” which he believed are drawn primarily by life’s experience and social conditioning. Money planted some of the earliest flags in the nature-versus-nurture war by claiming that dysfunctional parents, not inborn biology, is what produced “sissy boys,” tomboys, and other gender variants. But today, the pendulum has swung just about as far in the other direction as possible. A small constellation of researchers is specifically analyzing the traits and characteristics that, though more pronounced in some than in others, not only make us gay but also make us appear gay.
At first read, their findings seem like a string of unlinked, esoteric observations. Statistically, for instance, gay men and lesbians have about a 50 percent greater chance of being left-handed or ambidextrous than straight men or women. The relative lengths of our fingers offer another hint: The index fingers of most straight men are shorter than their ring fingers, while for most women they are closer in length, or even reversed in ratio. But some researchers have noted that gay men are likely to have finger-length ratios more in line with those of straight women, and a study of self-described “butch” lesbians showed significantly masculinized ratios. The same goes for the way we hear, the way we process spatial reasoning, and even the ring of our voices. One study, involving tape-recordings of gay and straight men, found that 75 percent of gay men sounded gay to a general audience. It’s unclear what the listeners responded to, whether there is a recognized gay “accent” or vocal quality. And there is no hint as to whether this idiosyncrasy is owed to biology or cultural influences—only that it’s unmistakable. What is there in Rufus Wainwright’s “uninhibited, yearning, ugly-duckling voice,” as the Los Angeles Times wrote a few weeks ago, that we recognize as uniquely gay? Does biology account for Rosie O’Donnell’s crisp trumpet and Charles Nelson Reilly’s gnyuck-gnyuck-gnyuck?
“These are all part and parcel of the idea that being gay is different—that we are different animals to some extent,” says Simon LeVay, the British-born neuroscientist who has dedicated himself to studying these issues. “Hirschfeld was right. I support the idea that we’re a third sex—or a third sex and a fourth sex, gay men and lesbians. Today, there’s scientific documentation behind this.”
